1. About These Terms
These terms are an agreement between you and MigRizo ("MigRizo", "we", "us") for the use of migrizotalent.com, its dashboards and every service offered through them. By creating an account, sending a form or using the site, you accept these terms and our Privacy Policy.
These terms are an electronic record under the Information Technology Act, 2000 and do not need a signature. They are published as required by the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.
If you use MigRizo for a company, you confirm that you are allowed to accept these terms for it, and "you" includes that company.
2. Who Can Use MigRizo
- You must be at least 18 years old and able to enter a binding contract under the Indian Contract Act, 1872.
- Talent profiles are for people who live and are allowed to work in India.
- Employers can be based in any country, as long as hiring through MigRizo is lawful where they are.
- You may not use MigRizo if we have closed an account of yours for breaking these terms.
3. Your Account
Give us accurate details and keep them up to date. Keep your password to yourself and use one account per person. You are responsible for what happens under your account, so tell us straight away through the contact page if you think someone else has used it.
4. What MigRizo Does
MigRizo helps companies find, check and hire talent in India. We verify profiles, run the Maya interview, match people to roles and, when a company hires, set up the engagement: either a contractor agreement or employment through MigRizo as Employer of Record, with invoicing, payroll and compliance.
Every hire is covered by its own written agreement that sets out pay, fees, hours, notice, confidentiality and ownership of work. If that agreement says something different from these terms, the agreement applies.
5. Rules for Talent
- Tell the truth about your identity, experience, education and skills, and upload only genuine documents.
- Answer the Maya interview yourself, without another person answering for you.
- Only apply for roles you are willing to take, and keep employers informed if your plans change.
- Update your profile when your notice period, availability or other details change.
6. Rules for Employers
- Post only real roles that you intend to fill, with an honest description of the work, pay and hours.
- Never ask talent for money, deposits, paid training or the purchase of equipment.
- Use candidate information only to consider people for your roles. Keep it confidential and do not copy it out of MigRizo, sell it or share it with anyone else.
- Make hiring decisions fairly and follow the anti-discrimination law that applies to you.
- If you hire someone you were introduced to through MigRizo within 12 months of the introduction, do it through MigRizo or as your agreement with us sets out.
7. Fees and Payment
Talent never pay us. Employers pay the fees shown on our pricing or agreed in writing for each hire. Invoices are raised monthly in US dollars unless agreed otherwise. Prices do not include taxes such as GST, which are added where the law requires. Payment terms, late payment and refunds are set out in the employer's agreement with us.
8. What You Share on MigRizo
You keep ownership of what you upload: profiles, CVs, job posts and messages. You give us permission to store it, show it to the people it is meant for and process it to run the service, for as long as it stays on MigRizo. You confirm that you have the right to share it. We may edit formatting, and we may remove anything that breaks these terms.
9. What Is Not Allowed
As Indian law requires, you must not host, display, upload, change, publish, send, store, update or share anything that:
- belongs to another person and you have no right to share
- is obscene, pornographic, paedophilic or invades someone's privacy, including bodily privacy
- insults or harasses anyone on the basis of gender, or is racially or ethnically objectionable
- relates to or encourages money laundering or gambling
- is harmful to children
- infringes a patent, trademark, copyright or other intellectual property right
- misleads people about where a message came from, or knowingly shares false or misleading information
- impersonates another person or company
- threatens the unity, integrity, defence, security or sovereignty of India, its friendly relations with other countries or public order, encourages a crime, obstructs an investigation or insults another nation
- contains a virus or any code meant to damage or interrupt a computer system
- is clearly false and is shared to mislead or harass someone for money or to cause harm
- breaks any law in force
Platform Rules
- no fake profiles, fake jobs or offers used to collect personal data or money
- no spam, bulk messages or advertising to other users
- no scraping, copying or downloading profiles or jobs in bulk, by hand or with tools
- no attempts to get around security, access other accounts or overload the service
- no copying, reselling or rebuilding the service or its data
If you break these rules, we may remove the content, suspend or close your account, and report the matter to the authorities where the law requires.
10. Reporting Content and Complaints
If you see a job, profile or message that breaks these terms, or that you think is fake, report it through the contact page. Include the link so we can find it quickly.
- We acknowledge every complaint within 24 hours and resolve it within 15 days.
- A complaint about content showing a person in intimate or sexual images without consent, or impersonating them, is acted on within 24 hours.
- We act on valid orders from a court or government agency within the time the law sets.
If you are not satisfied with the Grievance Officer's decision, you can appeal to the Grievance Appellate Committee set up by the Government of India, within 30 days of receiving it.
11. Our Name, Content and Software
The MigRizo name and logo, Maya, the site design, our guides and the software behind the service belong to us or to those who license them to us. You may read and share links to our pages. You may not copy, republish or sell our content or software without written permission.
12. Closing or Suspending an Account
You can close your account at any time by asking through the contact page. We may suspend or close an account that breaks these terms, puts other users at risk or is required to be closed by law. Where we can, we tell you why first and give you a chance to respond. Closing an account does not end a signed hiring agreement, which ends only as that agreement says. The sections on fees, liability, indemnity and disputes still apply after an account is closed.
13. How the Service Is Provided
We run MigRizo with reasonable care and skill, but we cannot promise it will always be available or free of errors. We check profiles and job posts, but we cannot confirm everything a user tells us. Employers should carry out any further checks the law in their country requires before hiring.
14. Limits on Our Liability
As far as the law allows, we are not liable for indirect or unforeseeable losses, such as lost profit, lost business or lost data, or for the actions of other users.
Our total liability to you for any claim is limited to the fees you paid us in the 12 months before the claim, or ₹10,000 if you have not paid us anything. Nothing in these terms limits liability that cannot be limited under Indian law, such as liability for fraud.
15. Your Responsibility to Us
If someone makes a claim against us because you broke these terms or the law, or because of content you shared, you agree to cover the reasonable costs and losses we suffer as a result.
16. Changes to These Terms
We may update these terms as the service or the law changes. We update the date at the top of this page, and for important changes we tell you by email or on your dashboard at least 15 days before they take effect. If you keep using MigRizo after that, the new terms apply.
17. Governing Law and Disputes
These terms are governed by the laws of India. If you have a dispute with us, please raise it with The MigRizo Grievance Officer first, and we will try to settle it with you within 30 days. If it is not settled, the courts in the city of our registered office in India will have exclusive jurisdiction.
18. Contact and Grievance Officer
Questions about these terms and complaints go to The MigRizo Grievance Officer, at hello@migrizotalent.com or through the Contact and Grievances page.
